This Privacy Policy ("Policy") describes our policies regarding the collection, usage, protection and processing of personally identifiable information received from Users ("User", "You") of the https://roseon.io/ and its related applications and services ("Wallet", "We", "Our" or "Us").

We encourage you to read our Privacy Policy carefully before using our Wallet. We do not collect any information that may identify You without your permission. However by using the Wallet, you give us a consent and permission to collect, store and use the information about you, including your personal information, as prescribed by this Policy. You acknowledge and agree that such personal information may be transferred to and stored on the servers of the Wallet and the servers of authorized third parties.


Acceptance of Privacy Policy

By Accessing and using the Roseon wallet service, the user accepts the terms of this Privacy Policy and consents to the collection, use, and disclosure of personal information as described below. If the user does not agree with the terms set forth in this Privacy Policy they should immediately discontinue use of our service.


Information You Provide to Us

The personal information we collect is data that can be used to identify and verify the user directly or indirectly, or for contact purposes. This Privacy Policy covers all personal information voluntarily submitted  to our service and that we obtain from our partners.

Roseon wallet collects data for users that include legal first and last name, phone number, photograph, physical address, date of birth, state and country of residency, passcode, social security number or other government ID number, photograph of government-issued identification information, financial data including external wallet addresses and digital currency information, instructions provided to us in regards to trades and other activity conducted through our service, any feedback or suggestions users provide to us regarding our service, anytime a user contacts us or provides information via any of our support channels (whether via email, chat or other communication channel), and any other information you provide to Roseon wallet or authorize us to access or collect from a third party.

Roseon wallet holds and processes only the personal data absolutely necessary for the completion of our duties and limits access to personal data to only those necessary to complete such duties.


Information Collected Automatically by our Service

Roseon wallet automatically collects the following information whenever our service is used: (a) information about the computer or mobile device that is used to access our service including hardware model, operating system and version, browser version, unique device identifiers and mobile network information; (b) server logs in connection with any use of the service including  type of browser used, access times, pages viewed, and IP address; (c) other technical data collected through cookies and other similar technologies that uniquely identify the user’s browser; (d) transaction details related to use of our service including Roseon wallet Account balance, trades, orders, transfers, and any other transactions conducted or attempted through our service, and; (e) date, time and geographic location information from which the service is being accessed in connection with providing our service.


Information Collected From Other Sources

Roseon wallet may obtain information about you from third party sources as required or permitted by applicable law, such as public databases, credit bureaus, identity verification partners, resellers, and channel partners, joint marketing partners, and social media platforms.

We obtain information about you from third party sources for the purposes of verifying your identity  and marketing purposes. These identity verification partners use a combination of government records and publicly available information in order to verify a user’s identity. Information provided by these partners include: Name, address, date of birth, legitimacy and verification of government issued identification presented to our service, status on sanctions lists maintained by public authorities, and other relevant data. We obtain such information to comply with relevant laws and regulations, including, specifically, Anti-Money Laundering (AML) and Know Your Customer (KYC) laws and regulations.


Request for Additional Information

If a user seeks to raise the limits set by Roseon wallet for their account, we may require the user to provide additional information to further verify your identity, address, or other personal information. We do this in order to meet our obligations in accordance with applicable AML/KYC laws and regulations, and/or to manage the risk associated with raising account trading and transfer limits. This information may include your date of birth, taxpayer or government identification number, photograph of a government issued identification, or other personal information. We may also obtain information about you from third parties such as credit bureaus and identity verification services.


How Information Collected Is Used

The primary purpose of collecting personal information from users or external sources is to provide a safe, secure, and smooth customer experience while safeguarding users from fraudulent or criminal activity. The information users provide Roseon wallet may be used for the following reasons including, but not limited to,: (a) to comply with our legal and regulatory obligations; (b) to detect, investigate, report, and deter instances of potentially prohibited or illegal activities, or violations to our User Agreement; (c) to verify user identity via third party databases and identity verification partners; (d) to send Company communications, notices, or account related information to the user; (e) to resolve disputes and troubleshoot problems; (f) to collect fees; (g) for the purposes of quality control and staff training ; (h) for the purposes of enhancing security, monitoring or verification processes; (i) to customize, measure, and improve our services; ( j ) to deliver promotional communications from Rosewallet (from which users may opt out).


Security

Roseon wallet understands how important your privacy is and takes reasonable measures designed to protect the information collected from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. We maintain appropriate physical, technical, and administrative safeguards to protect the security and confidentiality of the personal information provided to us. We protect your personal information by maintaining physical, electronic, and procedural safeguards in compliance with the applicable laws and regulations. In the event of a security breach, Roseon wallet will make all commercially reasonable efforts to notify the user without undue delay.


Why and When We Share Personal Information With Other Parties

Roseon wallet takes care to allow your personal information to be accessed only by those who need to in order to perform their tasks and duties, and to share with third parties who have a legitimate purpose for accessing it. We may disclose any information we collect with affiliated and non-affiliated third parties in the following circumstances: (a) For identity verification or fraud prevention purposes, which allows the Company to verify information provided by the user against public records to confirm their identity; (b) For the purpose of sharing with service providers under contract who help with parts of our business operations. Our contracts require service providers to only utilize user information in connection with the services they perform for us, and prohibit them from selling your information to anyone else; (c) In the event of a planned merger or acquisition with another company or entity, should such an event occur, Roseon wallet will require the newly combined entity to adhere to this Privacy Policy with respect to user personal information; (d) When compelled by court order, subpoena, or similar legal procedure or when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our User Agreement or any other acceptable policies, Roseon wallet may disclose personal information with law enforcement or other third parties with legal authority to compel such information.


Account Information

Users may access and update their Roseon wallet account profile information by logging into the service’s mobile application or through a web interface or via API. Upon account closure, Roseon wallet may retain personal data information collected during sign-up and use of the service as required by law or for legitimate business purposes. Roseon wallet will retain your personal information for a minimum of five years or as necessary to comply with our legal obligations or for other legitimate business purposes.


Individual Rights of European Union Citizens

Residents of the European Union have the following rights, per E.U. data privacy law, which they can make use of by sending a request via the services support channel for consideration under applicable law: (a) the right of users to withdraw their consent to the processing of personal information at any time and for any reason. The user’s withdrawal of consent shall not affect the lawfulness of Roseon wallet’s processing of user information prior to withdrawal of consent; (b) the right to request a copy of the user’s personal information maintained by Roseon wallet. The user’s right to access this information will only be affected when the rights of those other than the user making the request would be infringed upon or when the right to access this personal information unduly burden, financially or otherwise, Rosewallet; (c)  the right to request erasure of personal information in certain circumstances including when the information is no longer necessary in relation to the purposes for which it was connected, the user having withdrawn consent, or during instances where information was collected during unauthorized access and the legitimacy of the activity has come into question; (d) users have the right to object to the processing of personal information when users contest the accuracy of personal information that Roseon wallet processed, when the processing of personal information is unlawful and erasure of personal information is not an option, when Roseon wallet no longer requires personal information for the processing of transactions, but rather for the personal information to be used for legal purposes, and the user has objected to the processing, pending the verification whether the legitimate grounds Rosewallet’s processing override your rights; (e) the right to object to the processing of personal information, as permitted by applicable law, whenever processing is based off of the user’s consent; (f) the right to receive notification correction, restriction, erasure or modification to user’s personal information; (g) the right not to be subjected to automated decision-making processes including, but not limited to profiling; (h) the right to lodge a complaint with the Company if the user believes we have infringed upon their rights. In such an event, we encourage the user to contact us first at support@roseon.io  so that we can attempt to resolve the issue informally.


Denial of Access to Your Personal Information

Roseon wallet may deny access to your personal information in the following circumstances: (a) when denial of access is required by law; (b) when doing so would infringe upon the privacy of another user; (c) to protect the rights and properties of Roseon wallet; (d) when the request being made is unduly burdensome or frivolous in nature.
